Like other members of the academic community, the students are expected to conduct themselves in accordance with standards of the college that are designed to perpetuate its educational purposes. Students shall respect and obey civil and criminal law, and shall be subject to legal penalties for violation of laws of the city, county, state, and nation. A charge of misconduct may be imposed upon a student for violating provisions of college regulations and the State Education and Administrative Codes. Where a student is subject to a charge of misconduct, such charge shall be processed in accordance with the following policies and procedures which will be applied in a fair and equitable manner. Disciplinary action may be imposed upon a student by an instructor, an administrator, or the Governing Board for proven misconduct or actual violation of specified college rules and regulations. Instructors and administrators may place students on probation or temporary exclusion with respect to actions in a classroom, on campus, or at a college- sponsored activity within the procedures specified in this document. The Vice President of Student Development shall have the power to impose suspension and to recommend expulsion. A charge of misconduct, harassment, violation of the Student Code of Conduct, allegation of academic dishonesty and/or other violation may be brought against a member of the campus community. Any charges must be submitted and signed; forms outlining required information are available from the Welcome Center and Vice President of Student Development. Due Process – a fair and balanced review of the facts shall include the right to appeal The Vice President of Student Development shall receive a signed, written statement and confer with the individual charged to advise them of the charge, possible sanctions, and the process including their rights. A review of the facts will result in a decision by the Vice President of Student Development as to any disciplinary actions that may be imposed. The student has the right to file a grievance, disagreeing with the decision. Disciplinary Action – violations of the code of conduct have consequences The District has established a range of penalties for violations of the Student Code of Conduct that range from verbal and written warnings, to formal reprimands, removal from class, and 1815.indd 149 7/24/17 12:20 PM Code of Conduct Code of Conduct short-term suspensions up to expulsion from all colleges in the district when the presence of a student causes a continuing danger to the physical safety of the student or others. Disciplinary actions will focus on corrective measures and will follow due process. Right to Grieve – a student can appeal a decision Any student has the right to appeal a decision by filing a grievance if the student reasonably believes a college decision or action has adversely affected their status, rights, or privileges as a student. This wrong must involve an unjust action or denial of student rights as defined by the College, VCCCD, or legal judgment. A grievance exists only when such an error or offense has some demonstrably correctable result. Students are subject to charges of misconduct for acts on college- owned or controlled property or at a college sponsored activity included, but not limited to: 1. Causing, attempting to cause, or threatening to cause physical injury to another person or to one’s self. 2. Possession, sale or otherwise furnishing a weapon, including but not limited to, any actual or facsimile of a firearm, knife, explosive or other dangerous object, or any item used to threaten bodily harm without written permission from a district employee, with concurrence of the College President or designee. 3. Use, possession, distribution, or offer to sell alcoholic beverages, narcotics, hallucinogenic drugs, marijuana, other controlled substances or dangerous drugs while on campus or while participating in any college-sponsored event. 4. Presence on campus while under the influence of alcoholic beverages, narcotics, hallucinogenic drugs, marijuana, other controlled substances or dangerous drugs except as expressly permitted by law. (Use or possession of medical marijuana is not allowed on any college property.) 5. Committing or attempting to commit robbery or extortion. 6. Causing or attempting to cause damage to District property or to private property on campus. 7. Stealing or attempting to steal District property or private property on campus, or knowingly receiving stolen District property or private property on campus. 1815.indd 150 7/24/17 12:20 PM Code of Conduct Code of Conduct 8. Willful or persistent smoking (including e-cigarettes or use of similar mechanisms) in any area where smoking has been prohibited by law or by regulation of the college or the District. 9. Engaging in intimidating conduct or bullying against another student through words or actions, including direct physical contact, verbal assaults, such as teasing or name-calling, social isolation or manipulation, and cyber-bullying. 10. Engaging in harassing or discriminatory behavior. The District’s response to instances of sexual harassment will follow the processes identified in Board Policy and Administrative Procedures 3430. 11. Obstruction or disruption of classes, administrative or disciplinary procedures, or authorized college activities. 12. Disruptive behavior, willful disobedience, profanity, vulgarity, lewd, or other offensive conduct, on campus or during campus sponsored activities. 13. The persistent defiance of authority or abuse of District/college personnel. 14. Academic dishonesty, cheating, or plagiarism. 15. Dishonesty, forgery, alteration or misuse of District/college documents, records or identification, or knowingly furnishing false information to the District/college or any related off-site agency or organization. 16. Unauthorized entry to or use of District/college facilities. 17. Engaging in expression which is obscene, libelous, or slanderous, or which so incites students as to create a clear and present danger of the commission of unlawful acts on college/District premises, or the violation of lawful District administrative procedures, or the substantial disruption of the orderly operation of the District. 18. Violation of District/college rules and regulations including those concerning student organizations, the use of District/college facilities, or the time, place, and manner of public expression or distribution of materials. 19. Persistent, serious misconduct where other means of correction have failed to bring about proper conduct. 20. Unauthorized preparation, giving, selling, transfer, distribution, or publication of any recording or photography of an academic presentation in a classroom or equivalent site of instruction, including but not limited to written class materials, except as permitted by District policy, or administrative procedure. 1815.indd 151 7/24/17 12:20 PM Code of Conduct Code of Conduct Sexual Misconduct and Title IX Members of the Oxnard College OC community, guests, and visitors have the right to be free from sexual misconduct and any other form of sexual harassment and gender-based discrimination and violence. OC does not tolerate sexual misconduct, which includes, but not limited to: • Sexual harassment (in person, by text, or online) • Domestic violence • Dating violence • Sexual assault • Sexual stalking • Gender based hate crimes When an allegation of misconduct is brought to an appropriate employee’s attention and a Respondent is found to have violated any sexual misconduct policies, appropriate sanctions will be used to reasonably ensure that such actions are never repeated. Oxnard College has extensive services for victims of domestic violence, sexual assault, and stalking. Please visit the Student Health Center or the Vice President of Student Development for confidential services. Also, our campus police provide an array of resources that are respectful and confidential. Sexual Misconduct - What is it? Definition of Sexual Misconduct - Comprises a broad range of unwelcome behaviors focused on sex and/or gender that may or may not be sexual in nature. • Any intercourse or other intentional sexual touching or activity without the other person’s consent is sexual assault, and is a form of sexual misconduct under this policy. • Sexual misconduct encompasses sexual harassment, sexual assault, sexual exploitation, or gender based harassment, which is a form of harassment based on gender identity, gender expression, or nonconformity with gender stereotypes. 1815.indd 152 7/24/17 12:20 PM Code of Conduct Code of Conduct • Sexual misconduct may also encompass acts of a sexual nature, including acts of sexual stalking, domestic violence, and dating violence, intimidation, or for retaliation following an incident where alleged sexual misconduct or has occurred. • Sexual misconduct can occur between strangers or acquaintances, or people who know each other well, including between people involved in an intimate or sexual relationship, can be committed by anyone regardless of gender identity, and can occur between people of the same or different sex or gender. Other Definitions: Non-Consensual Sexual Contact - Non-consensual sexual contact is any intentional sexual touching, however slight, with any object, by a man or a woman upon a man or a woman that is without consent and/ or by force. The determination of whether an environment is “hostile” must be based on all of the circumstances. These circumstances could include: • the frequency of the conduct; • the nature and severity of the conduct; • whether the conduct was physically threatening; • whether the conduct was humiliating; • the effect of the conduct on the alleged victim’s mental or emotional state; • whether the conduct was directed at more than one person; • whether the conduct arose in the context of other discriminatory conduct; • whether the conduct unreasonably interfered with the alleged victim’s educational or work performance; • whether the statement is a mere utterance of an epithet which engenders offense in an employee or student, or offends by mere discourtesy or rudeness; • whether the speech or conduct deserves the protections of academic freedom or the 1st Amendment. Sexual Contact Includes - Intentional contact with the breasts, buttock, groin, or genitals, or touching another with any of these body parts, or making another touch you or themselves with or on any of these body parts; any intentional bodily contact in a sexual manner, though not involving contact with/of/by breasts, buttocks, groin, genitals, mouth or other orifice. 1815.indd 153 7/24/17 12:20 PM Code of Conduct Code of Conduct Non-Consensual Sexual Intercourse - Non-Consensual Sexual Intercourse is any sexual intercourse however slight, with any object, by a man or woman upon a man or a woman that is without consent and/or by force. Intercourse includes: vaginal penetration by a penis, object, tongue or finger, anal penetration by a penis, object, tongue, or finger, and oral copulation (mouth to genital contact or genital to mouth contact), no matter how slight the penetration or contact. Sexual Exploitation - Sexual exploitation occurs when a student takes non-consensual or abusive sexual advantage of another for his/her own advantage or benefit, or to benefit or advantage anyone other than the one being exploited, and that behavior does not otherwise constitute one of other sexual misconduct offenses. Examples of sexual exploitation include, but are not limited to: • invasion of sexual privacy; • prostituting another student; • non-consensual video or audio-taping of sexual activity; • going beyond the boundaries of consent (such as letting your friends hide in the closet to watch you having consensual sex); • engaging in voyeurism; • knowingly transmitting an STI or HIV to another student; • exposing one’s genitals in non-consensual circumstances; inducing another to expose their genitals; • sexually-based stalking and/or bullying may also be forms of sexual exploitation. Consent - Consent is clear, knowing and voluntary. Consent is active, not passive. Silence, in and of itself, cannot be interpreted as consent. Consent can be given by words or actions, as long as those words or actions create mutually understandable clear permission regarding willingness to engage in (and the conditions of) sexual activity. • Consent to any one form of sexual activity cannot automatically imply consent to any other forms of sexual activity. • Previous relationships or prior consent cannot imply consent to future sexual acts. • In 2016, the State of California recently a law (Senate Bill 967), known as the Yes Means Yes law, requiring both parties who are engaging in sexual activity to give an on-going consent. 1815.indd 154 7/24/17 12:20 PM Code of Conduct Code of Conduct Force - Force is the use of physical violence and/or imposing on someone physically to gain sexual access. Force also includes threats, intimidation (implied threats) and coercion that overcome resistance or produce consent (“Have sex with me or I’ll hit you. Okay, don’t hit me. I’ll do what you want.”) Coercion - Coercion is unreasonable pressure for sexual activity. Coercive behavior differs from seductive behavior based on the type of pressure someone uses to get consent from another. When someone makes clear to you that they do not want sex, that they want to stop, or that they do not want to go past a certain point of sexual interaction, continued pressure beyond that point can be coercive. • Cases will be investigated regardless of whether the accuser resisted the sexual advance or request, but resistance is a clear demonstration of non-consent. The presence of force is not demonstrated by the absence of resistance. Sexual activity that is forced is by definition non-consensual, but non-consensual sexual activity is not by definition forced. • In order to give effective consent, one must be of legal age (18 years or older). • Sexual activity with someone who one should know to be -- or based on the circumstances should reasonably have known to be -- mentally or physically incapacitated (by alcohol or other drug use, unconsciousness or blackout), constitutes a violation. Incapacitation - Incapacitation is a state where someone cannot make rational, reasonable decisions because they lack the capacity to give knowing consent (e.g., to understand the “who, what, when, where, why or how” of their sexual interaction). I think I was assaulted. What do I do? 1. GO TO A SAFE PLACE. 2. FIND A LOVED ONE: Call a friend or family member to be with you. TALK TO SOMEONE WHO CAN HELP: It is advisable to report a sexual assault, even an unsuccessful attempt. The information you provide may prevent another person from being assaulted. When you report a sexual assault, any information you can remember about the attack will be helpful - the assaulter’s physical characteristics, voice, clothes, car or even an unusual smell. If you are not ready to report the incident officially, but wish to confidentially share what happened to you with someone who can help, contact the Oxnard College Student Health Center and ask to speak to a licensed counselor. Explain you need to have a confidential discussion with someone. CALL POLICE: If you have been sexually assaulted, you should call the police as soon as possible; do not bathe or change your clothes. Semen, hair and material under fingernails or on your clothing may be useful in identifying and prosecuting the assaulter. If the assault occurred on campus, call Campus Police at (805) 678-5805. If the assault occurred off campus, call 911. 4. HELP YOURSELF: It is very helpful to contact a local rape crisis center (805.983.6014), where qualified staff members may assist you in dealing with your trauma. If you are unable to make the contact yourself, have a friend, family member or police make the call. DON’T BLAME YOURSELF: Finally, it is important to remember that many individuals will mistakenly blame themselves for the assault. However, being sexually assaulted is not a crime - the crime has been committed by the person who assaulted you. Title IX Sexual harassment, sexual violence and other gender-based harassment occurring in the college setting implicates a federal law called Title IX of the Higher Education Amendments of 1972, which prohibits discrimination on the basis of sex in education programs or activities and which triggers certain responsibilities on the part of the college. Oxnard College has a Title IX Coordinator who can help explain the college’s responsibilities in these cases. The Title IX coordinator’s Office is located in the Student Service Building. The college will not tolerate acts of sexual harassment or sexual violence or related retaliation against or by any employee or student. When sexual harassment or sexual violence has occurred and is brought to the attention of a responsible administrator, steps will be taken to end the harassment or violence, prevent its re-occurrence, and address its effects. Reporting Options Within the college’s processes, the person making the allegations is referred to as the Reporting Party or Complainant. The person who the allegations have been made against is referred to as the Respondent. A complainant who wishes to report sexual harassment, sexual violence or other gender-based harassment may report their complaint directly to the Title IX Coordinator. If the incident happened on campus, you may contact the Campus Police Department or the Student Health Center. If a report is initially made with Campus Police or the Student Health Center, authorized personnel in those departments may refer cases to the Title IX Coordinator, but only with the victim’s consent. A complainant may pursue both the campus process through the Title IX Coordinator and the criminal process simultaneously. In addition, students may file a Title IX complaint with the Office for Civil Rights of the U.S. Department of Education. The Title IX Coordinator has authority to address complaints of sexual harassment and sexual violence in a non-criminal context. This campus process is completely separate from the police and courts. Within Oxnard College, the identity of the respondent determines which of the two offices handles the case. When the respondent is a student at the time of the incident, the Title IX Coordinator provides a student conduct process for investigating those cases whether they occur on or off campus. For cases where the respondent is an employee, those cases are handled by the District Human Resources Department. When the respondent is both a student and an employee, the two offices may work together to resolve the case. If you are uncertain about which office to contact you may call either office. When the respondent is neither a student nor employee at OC, the college can still assist you with counseling and other support services—contact the Student Health Center for these services. College employees must refer reports of sexual harassment, sexual violence, or other gender-based harassment to the Title IX Office.
